GENERAL TERMS AND CONDITIONS OF MADAME CHARLIE
This page (together with our Privacy Policy) tells you information about us and the legal terms and conditions (Terms) on which we sell any of the products (Products) listed on our website (our site) to you.
These Terms will apply to any contract between us for the sale of Products to you (your or the Customer) (Contract). Please read these Terms carefully before placing an order and make sure that you understand them. Please note that by ordering any of our Products, you agree to be bound by these Terms and the other documents expressly referred to in it.
We amend these Terms from time to time. This version was created on 12 February 2024. Please check these Terms to ensure you understand the terms which will apply at that time.
ABOUT US
We are Charlies Wonderful Food Family BV (Madame Charlie), a limited liability company registered with the Chamber of Commerce in Amsterdam, the Netherlands under (KVK-)number: 91241936 with our registered office at Bickerswerf 21, 1013 KV Amsterdam, the Netherlands.
We an artisanal bakery operating under the trade name of Madame Charlie and Madame Charlie Bakery and operate the website www.madamecharlie.nl.

USE OF OUR SITE
By using our site, you confirm that you accept these terms of use and that you agree to comply with them. If you do not agree to these terms of use, you must not use our site.
APPLICABILITY
The general terms and conditions of sale apply to all offers by, orders with, deliveries by and payments to Madame Charlie. By placing an order, you, the customer of Madame Charlie, indicate that you accept these terms and conditions.
We may revise these Terms from time to time in the following circumstances:
- changes in how we accept payment from Customers;
- changes in relevant laws and regulatory requirements; and
- any other matter that may arise from time to time.
Every time you order Products from us, the Terms in force at that time will apply to the Contract between you and us.
Whenever we revise these Terms, we will keep you informed and give you notice of this by stating that these Terms have been amended and the relevant date at the top of this page.
STATEMENT OF OWN USE
Products purchased from Madame Charlie are intended for your personal use only. Under no circumstances may products be resold to third parties, unless otherwise agreed. The brand name or logo of Madame Charlie may not be used.
YOUR PERSONAL INFORMATION
We only use your personal information in accordance our privacy policy (Privacy Policy). Please take the time to read this, as it includes important terms which apply to you.
PRODUCTS
Madame Charlie is an artisan bakery. Products are made by hand and hand finished. Although we have made every effort to display the products accurately on our site, flyers or on any other marketing materials or social media channels: the shape, colour, texture, taste and weight of a Product may differ from its description and from the photo shown with the Product.
The packaging of the Products you receive may vary from that shown on the images on our site.
All Products shown on our site are subject to availability. We will inform you by e-mail as soon as possible if the Product you have ordered is not available and we will not process your order if made.
We reserve the right to publish photographs of your order onto our social media channels and our website.
As our kitchen does handle nuts we cannot guarantee that traces of nuts will not be found in our products and therefore we do not accept any liability for any damage to health or any distress caused to you by the consumption of such Products.
PRICES
Prices of Madame Charlie are non-binding.
All prices are in EUR (€). We do not accept any other currencies.
The prices of the Products will be as quoted on order.
The price of a Product does not include delivery charges. We will provide you with delivery charges on order.
All applicable prices always include VAT.
We use our best efforts to ensure that the prices of Products are correct at the time when the relevant information was given. However if you discover an error in the price of Product(s) you ordered, please contact us as soon as possible.
Whilst we try and ensure that all the information on our site is accurate, errors may occur. In the unlikely event that the price and/or description of an item listed on the site has been incorrectly advertised, we will not be under any obligation to sell or provide those Products to you.
ORDERS
By placing an order at food markets, by telephone, by email or via our site, the agreement is a fact. Madame Charlie reserves the right to refuse orders without giving a reason, or to attach conditions to them, such as asking for a deposit (does not apply to orders made through the site).
PAYMENT
At Madame Charlie, you fulfil your obligations, arising from the agreement referred to under "Orders", through paying via the site, or by PIN/cash payment at food markets in the case of an order placed by telephone, email or on the spot, unless otherwise agreed.
DELIVERY AND COLLECTION
Delivery is available to all the areas listed on the Orders and Delivery page on our Site. We reserve the right to cancel any orders placed outside these areas.
The Products ordered by you can only be delivered to the delivery address provided by you to us, or collected by you from one of our pick-up locations as stated on our site.
If for any reason no one is present to receive delivery of your order from the address provided, or collection is not made within the given time slot, we will take the products back to our bakery and hold the goods for 24 hours during which you may phone +31 627362418 or email to charlie@madamecharlie.nl to request re-delivery or personal collection.
Please note re-delivery is subject to availability and will be subject to an additional charge. We also cannot be held responsible for any deterioration in the Product should this occur. It may from time to time be necessary to deliver outside of our delivery window times due to circumstances beyond our control.
When placing an order for delivery, please be sure to provide a telephone number on which our driver can contact you or the recipient should there be any problems in delivering the order.
We shall not be liable for any delay in delivering the Products, however caused.
We cannot accept responsibility for damage caused by you or by a courier/agent engaged by you to collect Products from us if they are damaged during transit to you.
We cannot be responsible for delays to deliveries caused by circumstances beyond our control. This includes (but isn't limited to) traffic issues caused by accidents, road closures and Police incidents, or stop and search, etc.
Under no circumstances shall we be liable to you in respect of any complaint concerning any aspect of any Product which is not raised by you within 24 hours of delivery by us or collection by you or your courier/agent. We will require you to return any product to us for tasting and testing in the event of a complaint.
CANCELLATION AND REFUND POLICY
We hope that you will be pleased with your order. However, if upon collection or delivery of the Products you find that they are not those ordered by you or the order is incomplete, or a Product is in a damaged condition when you receive it, please notify us immediately by phone at +31 627362418 or email to charlie@madamecharlie.nl.
Any faults or issues with an order must be reported on the day of collection or delivery, otherwise we are unable to offer any replacement of refund. Madame Charlie reserves the right to either replace the Product in question with a new Product or refund or credit the related purchase price.
In the case of damaged goods you must retain the damaged Products and all packaging for inspection by us and also send photographic documentation of the order.
Subject to our report on the claimed damage and to these Terms and Conditions we will refund the price you paid for the returned Products together with the delivery charge, or, at our option we will provide you with a credit for further Products. Please state clearly your dispatch details in all communications to us.
We will only make a refund to the original credit card or debit card account used by you to make the online purchase. Legal ownership of the goods will immediately revert to us if we refund any such payment to you.
Since taste is a very personal matter and subjective we cannot accept the return of any products merely because you do not like the taste.
We will not accept the return of any Products which have been purchased from any outlet other than this Site.
TRANSFER OF RISK AND OWNERSHIP
The risk of delivered or collected products passes from Madame Charlie to you as soon as the transfer of the products to you, or your courier/agent, has taken place.
LIABILITY
Madame Charlie is not liable for damage that is not attributable to intent or gross negligence on the part of Madame Charlie or that is caused by circumstances that are not at the risk of Madame Charlie.
Madame Charlie assumes no responsibility for information, photographs and other forms of educational materials insofar as they are published under the responsibility of third parties. Madame Charlie is also not responsible for the actions and/or omissions of third parties.
Madame Charlie is not liable for misunderstandings, delays or improper handling of orders and communications as a result of the use of the Internet or any other means of communication with you, unless and insofar as there is intent or gross negligence on the part of Madame Charlie.
Liability for damage against you are already insured is excluded by Madame Charlie at all times.
MISCELLANEOUS
In the event of force majeure, Madame Charlie has the right, at its own discretion, to suspend the execution of any order, or to dissolve it without judicial intervention, by informing you in writing or by telephone, without Madame Charlie being obliged to pay any compensation, unless this would be unacceptable in the given circumstances according to the standards of reasonableness and fairness. Force majeure is understood to mean any shortcoming that cannot be attributed to Madame Charlie, because it is not due to its fault and is not for its account by virtue of the law, legal act or generally accepted opinions.
RIGHTS
All contacts and transactions with Madame Charlie are subject to all rights and claims of Madame Charlie. No part of the publications or publications of Madame Charlie may be reproduced, stored in digital form, or published in any form whatsoever without the prior written consent of Madame Charlie.
APPLICABLE LAW
All legal relationships between Madame Charlie and its clients are governed by Dutch law. Disputes between the parties will be submitted exclusively to the competent court in the Netherlands.
